PREAMBLE

The company IT COLLECTION SAS with a capital of 100,000 euros, whose head office is located at 3 rue de siam in Paris 75016 (France), registered with the RCS of Paris under the number 831 344 061, has for activity the creation, the realization and the commercial use of the RECC PARIS brand.

These General Conditions of Sale are intended to define the rules applicable in the context of the sale of products branded RECC PARIS (hereinafter "the product (s)") on the site, between the company IT COLLECTION and any person major physical person, non-commercial, having the legal capacity to contract, exclusively domiciled in the countries delivered by www.recc-paris.com (hereinafter "the Customer") purchasing a product on the site.

For the application of the present, it is agreed that the customer and IT COLLECTION will be collectively referred to as the "Parties" and individually referred to as the "Party".

These T & Cs. govern without restriction the sales of products made by IT COLLECTION on behalf of RECC PARIS from the site. IT COLLECTION reserves the right to modify these T & Cs at any time. by posting a new version on the site. The C.G.V. applicable are those in force on the site on the date the customer places the order; it being specified that any order for a product offered on the site implies the customer's full acceptance of the T & Cs. in force at the time of ordering.

Article 2-Products

The products offered for sale by IT COLLECTION under the name of RECC PARIS are those appearing on the site on the day of consultation by the customer. Each product is the subject of a descriptive sheet which, in addition to the photograph, will contain: The price, the sizes and colors available, the composition as well as the particular characteristics. Minimal differences between a product and its photograph may exist, depending in particular on the resolution and the definition of the colors of the user screen. Article 3-Price

Prices are indicated in euros for the French version of the site and in USD for the English version. Prices are inclusive of all taxes, excluding delivery costs; it being specified that the V.A.T. is that in force on metropolitan French territory on the day of the validation of the order. The delivery costs are communicated to the customer on the summary of the order before the validation of the latter and are expressed inclusive of all taxes. These costs are the responsibility of the customer and are invoiced in addition to the sale price of the products, they are offered from 120 € TTC purchase in Metropolitan France exclusively. For all deliveries, outside metropolitan France, the customer must pay the local taxes required by the country of delivery. The transfer of the risks of loss and deterioration of the products will be carried out after delivery and reception of the products by the customer. We reserve the right to modify our prices at any time but we undertake to apply the prices indicated on the site at the time of ordering. Article 4-Order and payment of products

-4.1 Ordering

The customer materializes his order by completing the following 5 steps

Step 4: Entering the delivery and billing details by the customer

All fields are required to complete the order; it being specified that unless the customer indicates otherwise, the billing address will automatically be the same as the delivery address. If the customer has already placed an order on the site, he has a customer account. In such a case, he will identify himself only with his e-mail address and password. The customer then checks all the information and clicks on "validate" to continue with his order.

Step 5: enter bank details

The customer will then access the secure payment screen of the partner of IT COLLECTION as specified in article 4.3 below. Payment is made online by credit card and Paypal only. The customer must enter his bank card number, its validity date as well as the 3 numbers of the visual cryptogram on the back of his card. If payment is accepted, the customer will be redirected to an order confirmation screen on the site. In the event of payment failure, the customer will have up to 3 attempts to re-enter their bank details. At the end of the 3rd refusal, the customer will be redirected on the site to a screen indicating the refusal of payment. -4.2 Order confirmation

As soon as the customer has accepted payment, the customer will receive an email confirming his order, and summarizing all the items ordered, the billing and delivery address as well as the delivery date. The validation of the order by the customer and the order confirmation sent to the customer by e-mail by IT COLLECTION under the name of RECC PARIS following the acceptance of payment constituting the conclusion of a sales contract between the parties and acceptance of the T & Cs. -4.3 Payment

The price of the products purchased is payable in cash, in full on the day the order is placed by the customer. Payment is made online by credit card (credit card, Visa, Mastercard) or Paypal when the customer confirms the order. The request for authorization to debit the card is made at the time of validation of the order on the site, except in the event of unavailability of the servers. -4.4 Order archiving

The order confirmation is recorded in the records of IT COLLECTION, which are themselves kept on a reliable and durable medium. The customer accepts that the order confirmation is considered as proof of the contractual relations between the parties.

  

Article 5-Delivery

RECC PARIS will deliver the orders accompanied by a delivery slip within a maximum of 6 working days for delivery to mainland France and 20 working days to any other destination, from the day following payment. of the order. Any order registered on the site from Monday to Friday before 1 p.m. will be processed the same day; after 1 p.m. it will be processed the next day. All orders placed on Friday after 1 p.m., Saturday and Sunday will be processed the following Monday; it being specified that the order placed on a public holiday will be processed the following day. Article 6-Receipt of the order-Complaint-Return

1 / Guarantee of conformity - Guarantee of hidden defects

• the risks and costs of return are the sole responsibility of the customer.

When the non-conformity has been noted, IT COLLECTION will offer the customer the reimbursement of the price of the order (price of the products and delivery costs) as well as the costs of returning the non-conforming product, at the latest within 30 days from the date of dispatch of the notification of confirmation of non-compliance by the site's customer service. In the event of a refund, IT COLLECTION will reimburse all of the products made compliant, as well as the shipping costs incurred, with the exception of taxes and customs paid by the customer upon delivery. Cash on delivery returns are not accepted. Upon receipt of a non-compliant item, IT COLLECTION bears the cost of return postage.

When the Customer acts as a legal guarantee of conformity, he:

Regarding the reimbursement of return costs, IT COLLECTION refers to the price list displayed by La Poste on March 1 of the current year (Colissimo delivery without registered mail). The Customer must send proof of the return costs incurred to Customer Service, by email or by post (above-mentioned address).

 

In the event of abnormal or abusive complaints, IT COLLECTION may refuse to serve a subsequent order.

 

This warranty does not cover defects caused by abnormal or faulty use or resulting from a cause unrelated to the intrinsic qualities of the items.

 

In any event, the above provisions do not exclude the application of the legal guarantee against hidden defects of articles 1641 and following of the Civil Code, in accordance with the provisions of article L. 217-4 of the Code of consumption. 2 / Amicable settlement of disputes

If any of the terms of these T & Cs were declared null, illegal or unenforceable by a court decision, the other provisions of the T & Cs will remain in force. In the event of litigation, the customer should apply as a priority to IT COLLECTION to obtain an amicable solution and in the absence of an agreement, the ordinary courts will have sole jurisdiction.
